Public Offer Agreement for the Provision of DSTUcrypt Services

1. Definitions

• The Provider — Elektronnyi Obih LLC (requisites are set out in Section 9).
• The Service / DSTUcrypt — the website dstucrypt.com.ua, the SDK wrapper, embeddable iframe widgets (signing, verification, encryption, QES sign-in), server-side APIs and documentation providing qualified electronic signature (QES) functions under DSTU standards in the browser.
• Subscription — a paid period of the right to use the Service on one domain of the Customer.
• The Customer — a natural or legal person who has accepted the terms of this public offer.

2. Subject Matter of the Agreement

2.1. The Provider grants the Customer a non-exclusive, non-transferable right to use the Service by connecting the widgets to the Customer’s own web resource (domain) for the duration of the paid Subscription period. Ownership and exclusive intellectual property rights in the Service remain with the Provider.

2.2. Cryptographic operations are performed in the End User’s browser; the private key and password are not transferred to the Provider.

2.3. Each new domain automatically receives a 7-day free Trial Period.

3.1. Payment is made online via the LiqPay payment service by bank card (Visa / Mastercard) in Ukrainian hryvnia.

3.2. The Subscription is recurring: payment is renewed automatically each period (month or year) until the Customer cancels it in the account dashboard. The Customer is informed of recurring charges and gives consent to them at the time of the first payment.

3.3. Access is activated immediately upon successful payment. The prices published on the website are those in effect at the time of payment; the Provider is entitled to change prices for future periods.

4. Rights and Obligations of the Parties

4.1. The Provider undertakes to provide access to the Service for the duration of the paid period and to use its efforts to ensure its uninterrupted operation.

4.2. The Customer undertakes to use the Service in accordance with the Terms of Use and the legislation of Ukraine, to pay for the Subscription in a timely manner, and not to infringe the Provider’s intellectual property rights.

5. Liability

5.1. The Service is provided “as is”. The Provider shall not be liable for indirect damages, and its aggregate liability is limited to the amount paid by the Customer for the current Subscription period.

5.2. The Provider is not a provider of electronic trust services (a qualified trust service provider / accredited certification authority) and does not issue keys; the Service only performs cryptographic operations with keys that the Customer/user has obtained from accredited providers.

6. Refunds

The refund procedure is set out in the Refund Policy, which forms an integral part of this agreement.

7. Term and Amendment of Terms

7.1. The agreement takes effect upon acceptance and remains in force until termination of the Subscription. The Provider is entitled to amend the terms of this offer by publishing a new revision on this page; continued use of the Service constitutes acceptance of the amendments.

8. Dispute Resolution

Disputes shall be resolved through negotiations, and if no agreement is reached — in accordance with the applicable legislation of Ukraine.
